Welcome to www.myco.consulting (the “Website”) operated by Myco Consulting LLC, a New York limited liability company (“Myco”, “we”, “our”, or “us”). This privacy policy (this “Privacy Policy”) is intended to inform you about how Myco collects and uses your personally identifiable information (“PII”) and other information in operating the Website.

 

How does the Website work?

 

The Website enables anonymous visitors to the Website (“Visitors”) to learn more about us and the services we provide, and Visitors who are at least eighteen (18) years of age and not a minor in their state of residence, to submit certain of their PII to us to become one of our registrants (“Registrants”) in various capacities, including without limitation to make a purchase or to submit a request to become a “Friend” or “Member” of Myco, and to register for certain of our activities and events. The terms “you”, “your” and “yours”, when used herein refer to either Registrants and Visitors or to both Registrants and Visitors collectively, as applicable.

 

Your use of the Website is subject to Myco’s Terms of Use for the Website, which can be found at https://www.myco.consulting (the “Terms of Use”).

 

You can make general use of the Website without providing any PII to Myco. However, you will need to provide us with certain PII in order to use certain of the Website’s functionality, such as becoming a Registrant.

 

By using the Website, you consent to the collection and use of your PII and other information by Myco as described in this Privacy Policy.

 

How can the terms of this Privacy Policy be modified?

 

We reserve the right to change how we handle and use the information that we collect through the Website, and to modify this Privacy Policy, at any time in our sole discretion. You agree to review this Privacy Policy periodically to be aware of all such modifications. You further agree that your continued use of the Website after a modified version of this Privacy Policy has been posted shall be deemed to be your conclusive acceptance of any modified version of this Privacy Policy. We will indicate that changes to this Privacy Policy have been made by updating the date indicated after the “Last Modified” indicator at the beginning of this Privacy Policy. If you do not agree to abide by the initial version and each modified version of this Privacy Policy, as applicable, then you are not authorized to use the Website. What type of PII does Myco collect from you and how do we use it?

 

Registrants must provide certain PII to Myco in order to register with us, including without limitation a Registrant’s name, address, email, and payment information. We may also ask you for general statistical, non-PII about yourself and your interests.

 

We intend to use all such information collected through the Website or otherwise from you for multiple purposes, including for our own research and decisions making purposes. We also will use such information to keep you informed about our activities by sending you emails, by reaching you by phone and for hard-copy mailings. And we will use your email addresses for our email marketing.

 

 

Registrants may also register to participate in various activities operated by third parties, including without limitation panel webinars, discussions, classes and workshops, or to take surveys or other information sharing activities. Registrants understand Myco is not responsible for and has no control over such activities and the parties conducting such activities. Therefore, please keep in mind that any PII or other information that you provide such third parties in the course of your participation in such activities or otherwise will not be subject to the terms of this Privacy Policy but rather to the terms of whatever privacy policy or other terms such third party may offer, if any.

 

How else do we use your PII?

 

Myco or entities working on our behalf may use your PII to help fulfill your requests in connection with your use of the Website and/or your participation in our activities, or to help us or third parties communicate with you about different resources offered as part of the Website or our activities, or otherwise. For example, we may transfer information collected at registration, including your PII, to service providers and other third parties who assist us in running the Website and/or in processing your registration at an event.

 

Under what other circumstances may we share or otherwise release PII?

 

In addition to sharing your PII with third parties as described above, we may also release your PII to other third parties if we believe that such release is necessary (a) to comply with the law (e.g., a legal process or a statutory or regulatory authorization or requirement) or a court order, (b) in order to apply or enforce the Terms of Use or otherwise protect our interests, (c) in order to protect you, other Visitors or Registrants, or us from fraudulent, abusive, or unlawful use of the Website or from other harm, or (d) if we reasonably believe that a danger to any person or property requires the disclosure of such PII.

 

Our rights under this Privacy Policy may be automatically assigned by us, in our sole discretion, to a third party or parties whose activities are consistent with our non-profit mission, and such an assignment will inure to the benefit of our successors, assigns and/or licensees.

 

What other information does Myco collect through the Website?

 

We may also collect anonymous and aggregate information from you about your preferences in navigating the Website by using cookies, action tags and other methods. Cookies are small text files that identify your computer and can track your behavior across multiple platforms. We may use cookies to, among other things, monitor usage of the Website, customize features of the Website, identify your computer’s or other device’s operating system and browser, and complete transactions. An action tag is a small, graphic image on a webpage that is designed to allow the website owner or a third party to monitor who is visiting a website by collecting the IP address of the computer to which the tag is sent, the URL of the webpage that the tag comes from and the time at which such webpage was viewed. Action tags may be associated with cookie information. We may also use such anonymous and aggregate information for promotional and other business purposes.

 

Do I have the ability not to be identified by Myco?

 

Yes. If you do not want to be identified by us, you can set your browser to warn you before accepting cookies and refuse cookies when your browser alerts you to their presence. You can also adjust the settings in your browser to refuse all cookies. If you do not want us to have any of your PII, do not submit any of your PII to us. Please keep in mind that if you refuse cookies you may not be able to use certain Website functionality, including without limitation using our registration mechanism to become a Registrant.

 

How do we store information?

 

Myco takes steps consistent with commercially reasonable industry standards to secure PII collected from you from loss, misuse, unauthorized access and destruction while under our control. However, please note that despite our efforts to protect information provided to us, we cannot guarantee that such information will not be lost, disclosed or accessed by accidental circumstances or by the unauthorized acts of others.

 

Does Myco provide links to other websites?

 

Myco may provide links to other websites or resources of possible interest to you. The collection and use of your PII and other information by such websites shall be subject to the policies and procedures of such websites and not those contained in this Privacy Policy. The information collected by our service providers or other third parties working on our behalf, including without limitation payment provider platforms in consummating purchases you may have made by means of the Website or otherwise in the course of assisting us, is subject to the privacy policies of such third parties and is not subject to this Privacy Policy.

 

What are our policies regarding children?

 

The Website is intended for general use by persons who have reached the age of consent in their state of residence and it is not targeted to anyone under thirteen (13) years of age. Myco does not knowingly collect PII from anyone under thirteen (13) years of age. If we learn that we have unintentionally collected PII from anyone under thirteen (13) years of age, we will promptly delete such information.

 

Do we respond to Do Not Track signals?

 

The Website does not have the capability to respond to “Do Not Track” signals received from various web browsers.

 

Do we have a mechanism to address the removal of PII and complaints about the handling of information that we collect?

What state (and other jurisdiction) specific provisions should I keep in mind?

 

FOR RESIDENTS OF CALIFORNIA 

To the extent Myco is subject to California privacy laws, if you reside in California then you will be afforded the additional rights listed below:

The Right to Notice of Categories of PII Collected

Myco may collect the following categories of PII as per the definitions outlined under California law:

  • Identifiers;

  • Characteristics of protected classifications;

  • Geolocation data;

  • Internet/electronic activity;

  • User records information;

  • Commercial information; and

  • Inferences drawn from the categories described above, in order to create a profile about you and to reflect your preferences, characteristics, behavior, and attitudes.
     

The Rights of Access, Deletion, And Equal Service
 

As a resident of California, you also have the following rights (subject to exemptions under the law):

  • Access: The right to request to know the categories of PII that Myco collects, the purpose for collecting and using such information, the categories and sources of said information, the categories of parties that Myco shares or sells PII to (if applicable), and the specific PII that Myco has collected about you;

  • Deletion: The right to request deletion of PII that Myco collects or maintains;

  • Opt-Out: The right to opt-out of any sale of PII; and

  • Non-Discrimination: The right to non-discriminatory treatment for exercising your rights under California law.

 

How To Exercise Your Rights Under California Law

In order to exercise your rights under California law, such as that of access, deletion, opt-out, and non-discrimination, please contact Myco.  We will employ verification procedures in line with California law to ensure that you are authorized to exercise these rights.

For information about our policies about the collection, use and sharing of your PII by us, please see our above explanations regarding these issues.  If you are a California resident, you may ask us to refrain from sharing your PII with certain third parties for marketing purposes. A Note on PII Shared with Online Advertising Platforms
 

The PII that Myco shares may include online identifiers such as IP addresses and device identifiers for online advertising. These identifiers being shared make it possible for Myco to advertise to you and its other users via platforms such as Facebook and Google. Said platforms may use this data to provide advertising services to others as well. Sharing this information with these service providers may be considered a “sale” of PII under California law, but Myco does not receive money in return and the information shared does not include your name or other contact information.

FOR RESIDENTS OF NEVADA

Myco does not sell your PII as per the definition of "sale" under Nevada's Revised Statutes Chapter 603A.

FOR RESIDENTS OF THE UK, EU AND EEA
 

GDPR

As per the UK and EU General Data Protection Regulation (GDPR), residents of the United Kingdom (UK), the European Union (EU), and European Economic Area (EEA), are afforded rights pertaining to the processing of their PII.  Each references to a “user” or “you” in this sub-section regarding GDPR refers to residents of the UK, EU, or EEA who are visiting and accessing Myco Website or App.
 

Data Controller Vs. Data Processor
 

Myco, in its general operations, is ordinarily deemed a data controller under the GDPR as opposed to a data processor. For this reason, data processing inquiries and requests relating to the rights afforded under the GDPR should be directed to Myco.


The Legal Bases for Processing of PII

As per the GDPR, Myco utilizes a variety of legal bases for the processing of a user’s PII, which are listed below:

Myco may process a user PII to meet obligations necessary under a contract with such user, to take action based on a user request, in anticipation of forming a contract with a user, or as is otherwise necessary for Myco’s contractual relationship with a user.

Myco may process, use, or disclose PII when necessary to comply with a legal obligation.

Vital Interests
 

Myco may process, use, or disclose PII where necessary to protect the vital interests of an individual.

 

Legitimate Interests
 

Myco may process PII on the grounds of legitimate interests of Myco or third parties where such interests are not overridden by balancing the interests and fundamental rights of users.
 

The legitimate interests of Myco may include:

  • Marketing activities;

  • Analyzing and improving Myco;

  • Protecting the interests of Myco, users, and employees;

  • Order fulfillment; and

  • Among other activities which benefit Myco.

Rights Relating to Automated Decision Making or Profiling

You may have rights if Myco conducts automated decision-making or profiling. Currently, Myco does not conduct such activities.

International Transfers of Data

 

Myco is based in the United States and the recipients of PII Myco collects and shares, as is outlined in the section above titled " Under what other circumstances may we release PII?", may also be located in the United States or some other jurisdiction. PII may be transferred, stored, and processed on servers outside of a user’s jurisdiction of residence, where privacy protections are lesser than those of user’s jurisdiction of residence. Continued use of the Website, or other interaction with Myco, constitutes your consent to such transfer.
